    Terms and conditions of sale for Hammerjack Web Store

    Validity of the Terms and Conditions of Sale

    • Terms andConditions of Sale apply between the buyer of the www.hammerjack.eu Web Store (hereinafter Buyer) and Hammerjack OÜ, Vae 4, Laagri, Saue Parish, 76401, Commercial Registry Code 10568247 (the "HJ Web Shop") for the purchase of goods and services.
    • In addition to these Terms and Conditions, the legal relationships arising from the purchase of products from the HJ Web Store are governed the Law of Obligations Act, the Consumer Protection Act, and other legislation in force in the Republic of Estonia.
    • The HJ Web Store reserves the right to make changes to the terms and conditions of sale. These changes will be reflected on the websitewww.hammerjack.eu

    Price and product information

    • All prices in the HJ Web Store are in EUR and include 22% VAT. Delivery charges may apply.
    • The delivery fee depends on the method of delivery, the amount of the purchase, and the location of the buyer. If "I will pick it up" is selected as the delivery method, the shipping cost will not be added to the purchase amount. If the purchase price is less than 100 €, the shipping cost of 6 € will be added to the purchase price. If the purchase price is more than 100 €, shipping costs will not be added, and the shipping within Estonia is free. When shipping goods to other countries, a shipping cost of 24 € will be added to the purchase price.
    • If the order is placed before any change in the terms of sale, or prices, the legal relationship between the buyer and the HJ Web Store will be governed by the terms applicable at the time the order is placed.
    • The HJ Web Store reserves the right to make changes to the terms and conditions of sale. These changes will be reflected on the websitewww.hammerjack.eu
    • The delivery times displayed on the HJ Web Store are approximate and more information on delivery times can be requested info@hammerjack.eu. Delivery time for the order depends on the manufacturer, and the delivery time is typically 7-60 days.
    • The images displayed on the HJ Web Store are illustrative. The actual product color may differ from the illustration, as it depends on the settings of each particular computer monitor.

    Entry into force of the sales contract

    • With the contract of sales of goods, HJ Web Store undertakes to hand over to the buyer an existing product, a product being manufactured or to be acquired by the JH Web Store in the future and to enable the transfer of ownership to the buyer, but the buyer undertakes to pay the HJ Web Store the invoiced amount and accept the goods.
    • The contract of sale enters into force upon receipt of the payment by the buyer to the bank account of the HJ Web Store.

    Placing an order and payment for goods

    • To place an order, you need to add the desired items to the shopping cart and click on the "Complete the order" link in the shopping cart. Purchases can be made on a one-off basis or as a loyal customer.
    • When placing an order, you must carefully fill in all required fields and choose the method of delivery and payment. It is also possible to pay for the goods with a gift card. Payments are made securely via the payment methods provided by Maksekeskus AS.
    • After the payment has been received on HJ Web Store, the order will be completed within one (1) business day, and the goods will be delivered to the buyer in the manner chosen by the buyer.
    • If the ordered goods cannot be delivered due to the running out of the goods or for any other reason, the buyer shall be informed thereof as soon as possible, and the money paid (including delivery costs) shall be refunded immediately, but not later than within five (5) business days of sending the message.
    • If the order contains goods that are not in stock at the time of ordering, the customer's order will be only be completed when all the products are in stock.

    Shipping

    • After the contract of sale enters into force, the HJ Web Shop will complete the order within one (1) business day and deliver it to the company's logistics partners. Orders placed in HJ Web Shops are processed on weekdays on Mon-Fri from 09.00 to 17.00. If the order is placed on Friday after 14.00, the order will be processed the following Monday.
    • Shipments within Estonia generally reach the destination specified by the buyer within 1-3 working days from the entry into force of the sales contract. Outside Estonia, the goods will be delivered to the destination within 3-5 working days from the entry into force of the contract of sale.
    • For prompt delivery, you must be careful when placing your order and provide true and valid information when you enter your delivery information.
    • In exceptional cases, the delivery may take place within up to 45 calendar days.
    • The HJ Web Store is not responsible for the delay in delivery of the goods if the goods have been delivered to the logistics partners in due time, but the delay is due to circumstances beyond the control and foreseeability of the HJ Web Store.

    Delivery of the goods

    Hammerjack has three options for delivering the parcel. When you are in the final phase of placing your order, you can choose between three different modes of transport:

    1.  DPD Courier Service  delivers a parcel to your home.
    2. Omniva delivers the parcel to the parcel terminal or post office of your choice. 
    3. Pick the parcel up yourself at Hammerjack's warehouse at Vae 4, Laagri, Saue Parish, Harju County 76401

    With Omniva it is possible to ship goods with a maximum size of 39 cm (height)*38 cm (width)*64 cm (length) and with a real weight not exceeding 30 kg.  If you have chosen an Omniva parcel machine, but the parcel size is larger, we will contact you and agree where we will send the parcel by DPD courier. With the DPD courier service, you can send on a door-to-door basis smaller packages as well as large pallets.

    Cost of transport:

    If the order is less than 100€, the shipping fee of 6€ will automatically be added to the order. However, if you order more than 100€ , transport for you is free of charge!

    If you wish to order goods elsewhere in Europe , shipping cost 24 € will be added to each order.

     

    Right of withdrawal

    • After receiving the order, the buyer has the right to withdraw from the contract concluded in the web store within fourteen (14) days.
    • The right of withdrawal does not apply if the buyer is a legal person.
    • To exercise the right of withdrawal from the contract, the buyer must complete the withdrawal form accompanying the goods and return the product according to the guidelines. The return form can also be downloaded HERE. The original packaging of the product must be undamaged, and the product unused/unworn.
    • In the event of a deterioration in the condition of the object to be returned, the purchaser shall be liable for any diminished value resulting from the use of the product only if he/she has used the item in another way than is necessary to ascertain the nature, characteristics, and functioning of the object. In order to ascertain the nature, characteristics, and functioning of an object, the consumer should only handle and use the object as he/she is normally permitted in the shop.
    • The HJ Web Store will return to the buyer, immediately upon receipt of the notice of withdrawal, but no later than fourteen (14) days, any fees received from the buyer under the contract, including postage for delivery to the purchaser.
    • The buyer must return the goods within fourteen (14) days of submitting the application or provide proof that he has handed over the goods to the logistics company within this period.
    • When returning goods through a logistics company, the buyer is responsible for the proper packaging of the product, taking into account the packaging company's packaging requirements.
    • The buyer does not have to return the goods through a logistics company if the HJ Web Shop has agreed to accept the goods at the Hammerjack OÜ retail store.
    • The HJ Web Store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the HJ Web Store is, by mistake, markedly below the market price of the goods.

    Force majeure

    The HJ Web Store shall not be liable for any damage or delay in the delivery of goods to the buyer if the loss or delay in delivery is due to circumstances beyond the control or foreseeability of the HJ web store.

    Processing of personal data and direct marketing

    • HJ Web Store will only use the personal information (including name, phone number, address, email, address, bank details) entered by the buyer to process the order and send the goods to the buyer. The HJ Web Store transmits personal information to the transport company for the purpose of delivering the goods. The personal data necessary for the execution of payments is transferred to authorized processor Maksekeskus AS.
    • The buyer shall have the right at any time to prohibit the collection and use of his/her personal information except to the extent required to recover a claim under the contract, or to deliver the goods.
    • The HJ Web Store will only send newsletters and offers to the buyer's email address if the buyer has requested to do so by entering an email address on the website and announcing their wish to receive direct mail notifications.
    • The use of electronic personal data for direct mail is subject to the express consent of the buyer through the websitewww.hammerjack.eu.
    • Buyers can opt-out of email offers and newsletters at any time by notifying thereof via email info@hammerjack.eu  or following the instructions in the email containing the offers.
    • When making purchases with encrypted data communication banks, the buyer ensures the security of his/her personal bank identifiers, and the HJ Web Store does not have access to them.

    Procedure for submission of complaints

    • The HJ Web Store shall be liable for any lack of conformity or defects in the goods sold to the buyer, which shall occur within a period of up to two (2) years from the date of delivery of the goods to the buyer. Within this first twelve (12) months of delivery of the object to the buyer, the defect is presumed to have already existed at the time of delivery. Rejection of this assumption is the responsibility of the HJ Web Store.
    • After 1 year, the burden of proof shall be borne by the party at fault.
    • In the event of a defect, the consumer has the right to contact the HJ Web Store no later than within two months by submitting the invoice on the basis of which the purchase was paid for.
    • Complaints are accepted on the basis of an invoice/delivery note issued by the HJ Web Store. In the case of some products also on the basis of a device with an undamaged serial number. If the serial number is damaged or illegible, HJ Web Store may refuse the provision of a free warranty service.
    • If the HJ Web Store has reasons to doubt whether the defect in the product is due to a manufacturing fault or the fault of the consumer, the cause of the defect shall be proved by expert examination.
    • If the goods are found to be defective, the use of the goods shall be terminated.
    • Replacement or repair of defective goods shall be agreed between the HJ Web Store and the buyer. The repair costs (postage, freight, labor, and material) will be covered by the HJ Web Store.
    • The HJ Web Store shall not be liable for any defects in the product caused by improper storage or improper use of the product due to the fault of the buyer.
    • Product non-compliance or defects, please submit a complaint to the email address In the event of myyk@hammerjack.eu stating the name and contact phone number of the person who placed the order, order number and precise description of the product non-compliance or a defect.
    • A claim for noncompliance or defect in a product must be filed within two months of the date on which the non-compliance or defect was discovered.
    • All complaints will be reviewed, and the buyer will be contacted as soon as possible, but no later than fourteen (14) days after receipt of the complaint.
    • The buyer has the right to demand a reduction of the purchase price or termination of the contract from HJ Web Store and claim a refund for the goods if HJ Web Store cannot be repaired or the goods cannot be replaced, or if the repair or replacement of the goods fails, or the HJ Web Store has failed to remedy the defect within a reasonable period of time and has caused unreasonable inconvenience to the buyer.

    Warranty conditions

    Warranty period

    • The HJ Web Store provides a manufacturer's warranty on goods sold.
    • The HJ Web Store is under an obligation to repair defects, as defined by the manufacturer in its warranty, during the required period.
    • The warranty period will apply from the date of the delivery note of the delivery of the goods.
    • The warranty service performed during the warranty period does not extend the warranty.

    Fulfillment of warranty

    Warranty service is based on an invoice/delivery note issued by the HJ Web Store and a device with an undamaged serial number. If the serial number is damaged or illegible, HJ Web Store may refuse the provision of a free warranty service.

    The warranty does not cover:

    • Operating faults and physical damages that are caused by accidental or deliberate damage or foreign matter penetrated into the device (extraneous objects, liquids, insects, excess dust, etc.).
    • Operating faults and physical damage caused by malfunctioning electrical systems (lack of grounding wire, damage to equipment electronics, faulty outlets, damage caused by electrical and telephone surges and interruptions, etc.).
    • Operating faults and physical damage caused by non-original components or unsuitable accessories.
    • Operating faults caused by service or modifications performed by a person unauthorized by the HJ Web Store.
    • Operating faults caused by the improper use of the equipment, and non-compliance with the requirements of the user manual.
    • Operating faults caused as a result of lightning or another natural phenomenon.
    • The warranty does not cover the wear of moving mechanical parts.

    Buyers have the right to appeal to the Consumer Disputes Committee

    If the HJ Web Store has refused to resolve the buyer's complaint or if the buyer disagrees with the solution offered by the HJ Web Store and finds that his/her rights or interests have been violated, the buyer may file a complaint with the Consumer Disputes Committee through the Consumer Protection Board. The Rules of Procedure of the Consumer Disputes Committee can be consulted and filed  here . The Consumer Disputes Committee is competent to resolve disputes arising from a contract between the buyer and HJ Web Store. The Committee's review of the buyer's complaint is free of charge.

    In order to resolve problems in the Member States of the European Union, the buyer may have recourse to the European Union consumer dispute resolution platform  ODR.
